Arbitration is an alternative dispute resolution process allowing parties in a family law matter to resolve their issues in a fast, fair, and legally binding manner without going to court. At Broadhurst Kooy LLP, we offer single issue arbitration services to assist parties in securing binding decisions on interim issues to help keep your matter moving forward.

Why choose arbitration?
There are many benefits to single issue arbitration including:

-
Timely Resolution: The family court system in British Columbia continues to face significant delays, often leaving families waiting months, or longer, for a hearing. Arbitration allows you to maintain more control over the process and get a legally binding decision faster.
-
Cost-Effective: A focused, single-issue approach can help minimize legal expenses and time spent.
-
Confidential & Private: Arbitration takes place outside of court, protecting your privacy.
-
Legally Binding: Decisions are final and enforceable, like a court order.

What issues can be resolved through single issue arbitration?

-
Parenting time and parenting schedules
-
Child support or Section 7 expense disputes
-
Spousal support variations
-
Division of specific family property or debt
-
Enforcement or interpretation of existing court orders or separation agreements
-
Any other focused family law issue both parties agree to arbitrate
How does the arbitration process work?

When parties to a family law dispute agree to arbitrate an issue, the parties enter into a written agreement to confirm that agreement. The benefit of single use arbitration is that the parties can tailor the process to meet their particular needs and/or tailor it to the issue that is to be the subject of the arbitration thus reducing the time required to deal with the issue which in turn can help keep costs down for parties. Once the evidence is presented and a hearing is completed, the arbitrator issues a written decision that is binding on the parties.

Whether you're represented by a lawyer or self-represented, family law arbitration is a flexible and accessible option for many BC families. Arbitration hearings can be conducted virtually or in person, depending on your needs.
